Terms of Service
Delivery Schedule:
Ink delivery must be scheduled in advance by the customer. Pickup and delivery will take place within the scheduled period, except on certain holidays determined by DormInk at its sole discretion. DormInk reserves the right to reschedule pickup and delivery times upon prior notice to the customer.
Delivery Procedure and Terms:
DormInk will arrive at the customer's location with a new cartridge and exchange it for their old cartridge. The customer agrees to relinquish their old cartridge for recycling to DormInk upon delivery of their new cartridge. DormInk reserves the right to refuse business if the old cartridge is not relinquished. DormInk is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer for pickup or delivery. The customer is responsible for initialing the pickup and delivery confirmation sheets unless otherwise instructed by DormInk.
Missed Delivery:
If the customer misses a scheduled delivery, the customer can reschedule for via email by emailing help@dormink.com and explaining their desired rescheduled date. In order to accommodate the customer for the missed scheduled delivery, DormInk charges a $5 reschedule fee per time change.
Payment:
The customer must pay the agreed-upon charges prior to service. All sales are final and all payments are non-refundable. Any questions or concerns regarding payments should be sent to help@dormink.com.
Refunds:
DormInk shall have no obligation to refund any amounts paid by the customer, but it may choose to do so at its sole and absolute discretion. Any questions or concerns regarding refunds can be sent to help@dormink.com.
Loss or Damage:
In the rare instance that your cartridge is lost or damaged by DormInk, we will issue you a refund or credit for the value of that cartridge. Any questions or concerns regarding loss or damage can be sent to help@dormink.com.
Disclaimer:
DormInk's liability shall be limited to general money damages in a maximum amount not to exceed the charges for the term of service paid by the customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of DormInk's liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer's exclusive remedy. In no event will DormInk be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not DormInk knew or should have know of the likelihood of any such loss or damages. DormInk disclaims all warranties, express or implied, with respect to the services rendered to the customer.
Venue and Choice of Law:
Any suit involving any dispute arising between DormInk and the customer may only be brought in the Southern Division of the United States District Court for the District of California, or in any California State Court having jurisdiction over the subject matter of the dispute or matter. DormInk and the customer hereby irrevocably consent to the exercise of personal jurisdiction and venue by any such court with respect to any such proceeding. These terms of service and the relationship between the parties shall be interpreted, construed, and governed according to the internal laws of the State of California, without reference to its choice of law rules.
